For shipments originated and destined within the country of Mexico (intra-Mexican), Carrier's liability for loss, damage or delay while such shipment is in the country of Mexico will be limited per the terms and conditions of Carrier's applicable Mexican bill of lading (whether or not such bill(s) of lading is (are) actually issued); applicable Carrier tariff(s); and/or Mexican law. Unless there is a law that is compulsorily applicable, in the event of a conflict between the bill(s) of lading, tariff(s) or the law of Mexico, the order of precedence in the event of such conflict will be as follows: 1) Carrier's applicable tariff(s); 2) Carrier's applicable bill(s) of lading; and 3) the law of Mexico.
Unless otherwise limited, in the event of loss, damage or delay to any shipment, Carrier's liability will not exceed ten cents (US $.10) per pound, per package, subject to a maximum liability of two hundred dollars (US $200.00) per shipment, whichever is lower, unless the Shipper has requested and paid for excess liability coverage.
