Legal Disclaimer

When a shipment is moving to Mexico from the United States or Canada, or from Mexico to another country, the Carrier's liability is limited by the terms of:

  1. The Carrier's tariffs
  2. The terms of the Carrier's Mexican bill of lading
  3. The laws of Mexico

These liability terms will apply whether or not a written bill of lading is issued. If these three items conflict in any way, they will apply in the order in which they are listed above unless there is a Mexican law which states otherwise.

The Carrier's liability begins only when a shipment physically comes under the Carrier's control and ceases upon delivery to a consignee in Mexico or to a freight forwarder, customs broker or agent, as may be applicable to the specific shipment.

  • Unless other tariff liability provisions apply, generally the Carrier's liability for loss, damage or delay while under the Carrier's control in Mexico will not exceed fifty cents (U.S. $0.50) per pound, per package, subject to a maximum liability of five thousand dollars (U.S. $5,000.00) per shipment, or the actual value, whichever is less. Excess Liability Coverage is available at a premium cost. However, the maximum liability for any one shipment may not exceed fifty thousand dollars (U.S. $50,000.00) total per shipment.
     
  • While a shipment is under the Carrier's control in the United States, liability is limited by the provisions of the Carrier's 301 tariff and Carrier's 100 tariff, items 780,848 and 849, as may be amended or renumbered from time to time. Additional tariffs, including, but not limited to, the following tariffs may also limit Carrier's liability: 277, 202 and 502.
     
  • While a shipment is under the Carrier's control in the United States, when no other liability limit applies, the Carrier's liability for loss, damage or delay will not exceed twenty-five dollars (U.S. $25.00) per pound, per package, subject to a maximum liability of one hundred thousand dollars (U.S. $100,000.00) per shipment, or the actual value, whichever is less. Excess Liability Coverage is available at a premium cost when there is no other liability limit applicable. Such Excess Liability Coverage is governed by the provisions of Carrier's 100 tariff, item 780 as may be amended or renumbered from time to time.
